11.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and Pequod's Pizza waive any right to a jury trial and agree that any such action shall be brought on an individual basis only.
11.4 Time Limitation on Claims
You agree that any claim arising out of or related to these Terms or our services must be filed within one (1) year after such claim arose. Any claim filed after such period shall be permanently barred, regardless of any statute of limitations to the contrary.
